1. Acceptance of Terms
By using Work Safer Smarter (“the Platform”), you agree to be bound by these Terms of Use and all applicable Canadian laws and regulations. If you do not agree, you must not use the Platform or any related services.
These Terms form a legal agreement between you and Work Safer Smarter.
2. Use of Services
● Access is provided for individual or authorized organizational use only.
● Sharing or transferring login credentials is strictly prohibited.
● Unauthorized copying, reproduction, distribution, or resale of content is not permitted.
You agree to use the Platform in a lawful manner consistent with the purpose of training, learning, and community engagement.
3. Membership & Subscriptions
● Certain courses, forums, or features may require a paid membership or subscription.
● Memberships automatically renew unless cancelled.
● You may manage or cancel your membership through your account settings or by contacting hello@worksafersmarter.ca
All fees are displayed in Canadian Dollars (CAD) unless otherwise stated.
4. Resellers & Licensing
● Only authorized resellers or partners may distribute Work Safer Smarter content.
● Resellers must follow brand, delivery, and conduct guidelines outlined in their agreements.
● Unauthorized commercial use, sublicensing, or resale of training materials is prohibited.
5. Copyright & Intellectual Property
All materials on Work Safer Smarter, including courses, graphics, videos, assessments, and written content, are the intellectual property of Work Safer Smarter or its licensors.
● You may not reproduce, distribute, or modify these materials except for personal or licensed organizational learning.
● Certificates of completion may not be altered, sold, or used to imply official certification or compliance recognition.
6. Refund Policy
Refunds may be granted within 14 days of purchase if:
● Less than 25% of the course has been accessed; and
● The request complies with our posted refund terms.

7. Platform Availability
We strive to maintain 99.9% uptime for all users. However, Work Safer Smarter reserves the right to:
● Modify, update, or remove content at any time;
● Suspend accounts found in violation of these Terms;
● Perform maintenance or upgrades without prior notice when necessary.
8. Disclaimers
● Training materials are for educational and informational purposes only.
● They do not constitute legal, compliance, or professional advice.
● Outcomes and learning results vary by user engagement and context.
You are responsible for applying information appropriately within your organization or jurisdiction.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute, claim, or controversy arising out of these Terms shall first be addressed through good-faith negotiation. If unresolved, it shall be submitted to binding arbitration under the Arbitration Act (Ontario). The seat of arbitration shall be Toronto, Ontario, and proceedings shall be conducted in English.
10. Code of Conduct
All users must:
● Engage respectfully in community spaces
● Avoid harassment or disruptive behavior
● Not share or misuse confidential training materials
We reserve the right to terminate accounts violating this code.
11. User Acknowledgment
At enrollment, users may be required to confirm acknowledgment:

12. Taxes
All prices are listed in Canadian Dollars (CAD) unless otherwise noted. Applicable sales taxes (GST/HST or provincial taxes) will be calculated at checkout in accordance with Canadian tax law.
Our payment processor (Stripe) manages the collection and remittance of applicable taxes where required.
13. Termination
We reserve the right to suspend or terminate access to our services at any time for violation of these Terms, including but not limited to:
● Breach of acceptable use policies
● Non-payment of fees
● Violation of our Code of Conduct
● Fraudulent activity
Termination does not relieve you of obligations for outstanding fees or unauthorized use of content.
14. Modification of Terms
We may update or modify these Terms at any time. Significant changes will be communicated by email or posted on the Platform. Continued use of the Platform after such changes constitutes acceptance of the revised Terms.
15. Force Majeure
We shall not be liable for delays or failure to perform obligations due to circumstances beyond our reasonable control, including natural disasters, cyberattacks, pandemics, power failures, or government actions.

17. Severability
